ABOUT OPENING AT THE INTERNATIONAL PRESS CONFERENCE (THE HAGUE, Monday, December 5, 2011)

Toussaint Alain, Monday, December 5, 2011, 11:22.
Embargo until 9:30

Ladies and gentlemen of the press,
Thank you for kindly accepting our invitation to this meeting taking place in just a few hours of the first appearance of President Laurent Gbagbo before the International Criminal Court (ICC).
After an investigation illuminates, Mr. Louis Moreno-Ocampo, Prosecutor of the ICC, has issued November 23, 2011, the judicial authorities of the Republic of Côte d'Ivoire, an international arrest warrant against the President Laurent Gbagbo, arbitrarily detained since April 11, 2011 in the north by the forces of Mr. Alassane Ouattara. On Tuesday, November 29, 2011, President Gbagbo was brutally and illegally deported to Europe, specifically Schvenigen Detention Center, located on the outskirts of The Hague.
We denounce the bias of a senseless procedure, allegedly judiciary, which led to the illegal transfer and equally illegal incarceration of President Gbagbo, the propitiation of political justice in a case handled by a court which, in this case is more politics than law. It is an illusion here, to think that justice would be guided by the search for truth.
The presence of President Laurent Gbagbo in the dock is clearly a miscarriage of justice, a deception, a move to liquidate politically, socially and physically a man who dedicated his life to defend his political ideas in a peaceful manner, to a democratic ideal and respect for the sovereign institutions of Côte d'Ivoire.
It should be noted that in this post-election conflict, the perpetrators are gentlemen Alassane Ouattara, Guillaume Soro and their mercenaries.
From the beginning of the post-election crisis, a commando "invisible" directed by Ibrahim Coulibaly alias "IB", former bodyguard of Mr. Alassane Ouattara and co-author of the 2002 rebellion perpetrated deadly attacks against the force enforcement and civilian neighborhoods of Abidjan.
What head of state, worthy of the name could have left its people to be massacred without asking the army to intervene to stand up against these mercenaries of Ouattara and end the massacre?Without the intervention of the government army of thousands of villages were wiped off the map of Côte d'Ivoire by the mercenaries of Mr. Ouattara.
It can not seriously be retained against President Laurent Gbagbo responsible for atrocities allegedly committed on civilian populations.
It should also be remembered that this entire crisis was born of an electoral dispute that could have been solved by the simple recount, as proposed by President Laurent Gbagbo.Unfortunately, Mr. Alassane OUATARRA categorically refused the recount, and preferred a military attack by his mercenaries to the seizure of power.Even the UN Secretary General held that the recount would be an "injustice" and preferred the bombing of civilians has caused thousands of deaths.
Thus the bombing of civilian sites by the UN and the French army, combined with the atrocities committed by the mercenaries of Mr. Ouattara culminated in the capture, sequestration, and the deportation of President Laurent Gbagbo to ICCI.
Thus, by the will of France, Ouattara was transferred to the ICC, President Laurent Gbagbo in violation of the Ivorian constitution and laws. This is a trial of neo-colonialism. The ICC has become the instrument, the matter of France, which uses it to satisfy his dark designs policies, dictate the political landscape in Africa, helping to power of friends or punish recalcitrant African leaders like President Gbagbo.
Indeed, the status of former Chief of President Laurent Gbagbo should have conditioned his transfer to prior authorization of the National Assembly requested by the Prosecutor General of the Supreme Court.
Moreover, as the current officio member of the Ivorian Constitutional Council, the transfer of President Laurent Gbagbo also required prior approval of the Constitutional Council, in addition to stopping the Indictment allowing his extradition.Neither of these procedures was not respected! None of the prior authorization was requested by the Ivorian authorities.
In addition, before any transfer, he returned the Ivorian authorities to obtain waivers from the Council of the United Nations Security Council and the European Union to allow the transfer of President Laurent Gbagbo legally given the extent travel ban which struck him.The Ivorian authorities are again unable to justify such exemptions.
How in these conditions can there be justice for treatment is the President Laurent Gbagbo?
Finally, the one reading the arrest warrant is sufficient to be convinced of its nullity.
Indeed, civil status contained therein in no way corresponds to that of President Laurent Gbagbo.Thus, it is mentioned in the warrant of a person named Laurent Gbagbo Koudou, identity does not match that of President Laurent Gbagbo.It is even mentioned in the warrant that the so-called Laurent Koudou Gbagbo, born May 31, 1945 in the village of "Mama, when President Laurent Gbagbo was born May 31, 1945 at Babri (Municipality of GAGNOA ).All show the precipitation, the amateur and the ulterior motives of the Ivorian authorities to see "liquidate" their main political opponent, President Laurent Gbagbo. Open October 3, 2011, the "investigations" were quickly completed, and not surprisingly, the indictment of the suspect favorite of the international community.
No offense to Mr. Ouattara, for an overwhelming majority of Ivorians and Africans, President Laurent Gbagbo remains one of the fathers of democracy and multiparty system in Côte d'Ivoire and Africa, an awakener of consciences, and above all a great pacifist.
President Gbagbo is agaisnt his own will, the main actor of a bad movie series B. There is an error because the real casting leading roles in the drama that is played in Ivory Coast since September 19, 2002, missing:- We believe in particular to Mr. Alassane Ouattara, war chief of the armed rebellion became chief of the military commitment of France, the United States and the UN at the end of an electoral coup .- We also think Mr. Guillaume Soro, political and military leader of the rebellion, now Prime Minister Mr. Ouattara.- Finally, we consider all the mercenaries co-directed and financed by Mr. Ouattara and Soro, perpetrators of heinous crimes that caused the deaths of at least ten thousand people since September 18, 2002.
We are surprised that the prosecutor in the period he bounded to his investigation has overlooked the largest massacre of the post-election period has caused more than eight hundred dead in Duékoué.As observed at Duékoué, victims of  OUATTARA
forces were chosen based on their ethnicity and their supposed political affinity with the President Laurent Gbagbo.
More seriously, Mr. Ouattara has not only  not condemned the killings, but he promoted  and assinged responsibility for his mercenaries, despite criticism from international organizations that asked for sanctions against them.
Thus, organizing the appearance of shame, the ICC finally awarded a certificate of impunity and illegitimate tyrannical regime of Mr. Ouattara and his bloodthirsty forces. It creates a de facto jurisprudence that will surely be emulated in Africa and inspire future rebellions.
Thank you.

President Laurent Gbagbo imprisoned in The Hague: President Jerry Rawlings condemns the kidnapping

I learned with dismay that the deposed President of Ivory Coast, Gbagbo was transferred to the International Criminal Court (ICC) Tuesday, November 29 after a quick charge, in total violation of the international code of procedures and contempt total requirements for peace in Ivory Coast.

This transfer follows a procedure so fast, it can be legitimately described as a kidnapping.

My suspicions are further increased when the prosecutor claimed to have targeted six officials in the Ivory Coast, but insisted unduly on Gbagbo, who is least likely to escape because already in custody.

This willingness to charge and to transfer Gbagbo [who did not run escape during the bombing of the palace] as a common criminal, defying the logic of a quest for true reconciliation and lasting peace in Côte d'Ivoire.

After fifty years of independence, Africa should have all the know-how to bring justice to its own citizens and eliminate the Justice imported.

What kind of action is rather hasty to bring to justice the victim of an attack, and to bear with the author of the attack?

No one seeks to escape justice. But when justice is bathed in a sea of humiliation and abuse, so as to be governed by self-hatred with self-righteous logic untenable befits the human conscience to stand up against this justice for the good of all.

We will not remain silent about this because we must not remain silent about it because, all active members of this human drama.

The ICC in a completely illegal procedure regading President Gbagbo

Djaratche Gbi
On Monday, November 28, 2011, in a completely illegal procedure, the oldest judges of the Court of First Instance of Plateau commits a hearing of President Laurent Gbagbo on the offenses of "economic crimes". On Tuesday, November 29, 2011, against all odds, the Indictment Division of the Abidjan Court of Appeal notifies the President Laurent Gbagbo an international arrest warrant from the ICC. We then witness a boom in legal and political apparatus to arrive on the same day the transfer of President Laurent Gbagbo to the ICC in The Hague by a procedure just as illegal.

This is a farce and a travesty of justice implemented by President Ouattara to obey the injunctions of his sponsors(The New World Order). It is the supreme manifestation of hatred they devote to President Laurent Gbagbo to his political vision rooted in national sovereignty. It finally convinces the FPI and its allies, as well as national and international opinion on the final refusal of President Ouattara to see an Ivory Coast reconciled.

That is why the Central Committee instructed the Secretariat urgently to take appropriate legal measures, including the mobilization of structures, the national and international opinion and that, as part of the action unit within the NDRC, in order to obtain the final release and the return of President Laurent Gbagbo in Ivory Coast.

In addition, the Central Committee:

Condemns this real politico-judicial-hold-up transfer of President Laurent Gbagbo in The Hague while investigations are ongoing, which is a serious violation of the presumption of innocence accorded to every human being;

- Protests against this abduction policy which is more like a forced exile under the pretext of "international arrest warrant" while the real criminals are the rebels and their leaders whose cases are pending at the Cpi since 2004;

- Denounces collusion with the prosecutor Ocampo Alassane Ouattara on a background of massive corruption which indicators are, among others, the recent secret meeting between the two men in Paris and chartering a private plane by President Ouattara for the transfer of President Gbagbo, while Cpi has the means to that end;

-ensures support and unwavering solidarity of the party to President Laurent Gbagbo in the trial that they would face to the delight of Ivorians and Africans. Until the General Secretariat, in conjunction with the executive bodies of the respective allies of NIEA, undertake suitable actions, the FPI, under the decision of the Central Committee:

-Suspend its participation in any process of reconciliation and calls on all its officers to refrain from any activities relating thereto;

-Affirms that the transfer of President Laurent Gbagbo signs the breakdown of dialogue with the current "Republican government" and its allies. Finally, the Central Committee of the FPI activists ask all supporters, Democrats and African Ivorians to be ready and stay tuned to the Directorate for impending slogans to come.

1. On June 22, 2011, the President of the International Criminal Court ("Court") issued the Decision on establishment of the Pre-Trial Chamber III and reassigning the situation in the Republic of Côte d'Ivoire.

2. On October 3, 2011, Trial Chamber III ("Chamber") has decided, under Article 15 of the Rome Statute ("Statute"), to authorize the initiation of an investigation under the situation in the Republic of Côte d'Ivoire.

3. On October 25, 2011, the Prosecutor requested, pursuant to section 58 of the Statute, the issue of an arrest warrant against Laurent Gbagbo Koudou ("Laurent Gbagbo") to four counts of crimes against humanity, on the basis of individual responsibility of it in the commission of murder, rape and other forms of sexual violence, persecution and inhumane acts during the post-election violence, from November 28, 2010, Defence Forces and the Ivorian security (SDS) supported by the youth militia and pro-Gbagbo mercenaries (collectively "the pro-
Gbagbo "), in Abidjan, especially in the vicinity of the Hotel du Golf, and elsewhere in the country.

4. Having noted the articles 19-1 and 58-1 of the Statute, the Chamber says it will exhibit in a subsequent decision's analysis of evidence and other information provided by the Prosecutor.

5.Au seen the evidence and information provided by the Prosecutor, and without prejudice to the decision it makes with respect to any motion to dismiss may be raised later under Articles 19-2 and 19-a - 2-b of the Statute, the Chamber considers that the case of Laurent Gbagbo is under the jurisdiction of the Court and is admissible.

6. Given the evidence, the Chamber finds that there are reasonable grounds to believe that after the presidential elections in Cote d'Ivoire, the pro-Gbagbo forces attacked civilians in Abidjan and in western countries, from November 28, 2010. They have targeted civilians they believed to be supporters of Alassane Ouattara, and attacks were often directed against specific ethnic or religious communities.
7. The Chamber considers that there are reasonable grounds to believe that these attacks by pro-Gbagbo forces during the post-election violence have been conducted in accordance with the policy of an organization. In addition, they were of a widespread and systematic, as shown particularly the length of the period during which the crimes were committed (between November 28, 2010 and May 2011), the geographic extent of these (many of districts of Abidjan and western Côte d'Ivoire), the large number of victims that have been reported and the procedure generally followed in the commission of crimes.

8. Given the evidence, the Chamber finds that there are reasonable grounds to believe that crimes against humanity that took the form of murder (Section 7-1 of the Statute-a), rape and other forms sexual violence (Article 7-1-g) other inhumane acts (Article 7-1-k) and persecution (Article 7-1-h) were committed in Côte d'Ivoire from 16 December 2010 and April 12, 2011.
9. In addition, the Chamber finds that there are reasonable grounds to believe that these acts are befallen within a widespread or
systematic attack against the civilian population of Côte d'Ivoire, as defined in Article 7-1 of the Statute.

10. The Chamber considers that there are reasonable grounds to believe that, for the crimes alleged against him in the application for issuance of arrest warrant, Laurent Gbagbo urged his individual criminal responsibility as "indirect co-author" of such crimes meaning of section 25-3-a of the Statute. In particular, there are reasonable grounds to believe that Laurent Gbagbo and his immediate entourage (co-authors of the crimes) had agreed to a plan and they were aware that the implementation of it would, in the normal course events, the crimes listed above. Moreover, with that plan, the sponsors have exercised joint control over the crimes. Given the position and role of each in terms of the plan, the co-authors have contributed coordinated and essential to achieving the plan. There is a sufficient basis to conclude that the pro-Gbagbo forces who carried out the policy in question did so in obedience to the orders almost automatically they had received. Finally, there was sufficient evidence that Laurent Gbagbo has exercised the degree of intent and knowledge required.

11.Bien that the Chamber is satisfied that the substantive test (proposed by the prosecution) is filled, it is likely that the issue of liability attributed to Laurent Gbagbo as "indirect co-author" within the meaning of Article 25 -3-a of the Statute will be discussed in due course with the parties and participants.

12. Finally, the Chamber is satisfied that the arrest of Laurent Gbagbo is necessary to: i) ensure that it will appear before the Court; ii) ensure that it does not use his political power or financial means to block in the investigation or jeopardize the progress and iii) prevent the commission of other crimes.

FOR THESE REASONS, THE BOARD

DECIDES that the warrant should remain sealed, ex parte and reserved for the Prosecution and the Registry but to allow the transfer of Laurent Gbagbo at the headquarters of the Court, this office may, as appropriate, be communicated for its execution to third parties (such as the authorities of Côte d'Ivoire and any other State or international organization). The House will consider in due time the reclassification of the arrest warrant, after delivery of Laurent Gbagbo to the ICC,

DECIDES that, as soon as possible: i) the Registrar will prepare a request for
cooperation for the arrest and surrender of Laurent Gbagbo Koudou, containing the information and documents required under sections 89-1 and 91 of the Statute and Rule 187 of the Rules of Procedure and Evidence, and ii) Registry, in consultation and coordination with the Prosecutor, forward this request to the competent authorities of the Republic of Côte d'Ivoire, according to the
Rule 176-2 of the Regulations,

Also directs the Registrar, pursuant to Article 89-3 of the Statute, to prepare and transmit to any State and international organization concerned any request for transit as may be necessary for the surrender to the Court of Laurent Gbagbo Koudou,

ORDERS the Prosecutor to transmit to the Registry, to the extent that its confidentiality obligations permit, and the House all information in its possession that would avoid the risks that could pose to the victims or control the transmission of the request for cooperation susmentiormée,

Invites the Prosecutor to transmit to the Registry, to the extent that its confidentiality obligations permit, and the House all information in its possession which he said would facilitate the transmission and execution of the request for cooperation mentioned above,

DIRECTS the Registry to get in touch with the prosecution to invite the Republic of Côte d'Ivoire and the Kingdom of the Netherlands to seek a waiver of the travel ban imposed on Gbagbo by the Security Council of the United Nations and the Council of the European Union to allow the transfer of custody to the ICC and its entry into the territory of the Netherlands,

URGES the Registrar to take all possible steps to enable the immediate execution of this warrant.
